1. Agreement to Terms
By accessing or using The Whaler 1252 website, booking our services, or any applications made available by The Whaler 1252 (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not use our Services.
2. Reservation and Payment Terms
2.1 Booking Confirmation: A reservation is confirmed once we have received the required deposit or full payment, as specified at the time of booking.
2.2 Payment Schedule: Payment terms are as follows:
- A deposit of 25% of the total amount is required at the time of booking
- The remaining balance is due 60 days prior to check-in
- Reservations made within 60 days of check-in require payment in full at the time of booking
2.3 Accepted Payment Methods: We accept payment via credit card, debit card, and electronic bank transfers.
3. Cancellation Policy
Our cancellation policy is as follows:
- Cancellations made more than 60 days prior to check-in: Full refund less a $100 administrative fee
- Cancellations made 30-60 days prior to check-in: 50% refund of the total rental amount
- Cancellations made less than 30 days prior to check-in: No refund
- Early departure does not warrant any refund
We strongly recommend purchasing travel insurance to protect against unforeseen circumstances.
4. Property Rules and Guest Responsibilities
4.1 Occupancy: The maximum occupancy of the property is 4 guests. Exceeding this limit may result in termination of the rental agreement without refund.
4.2 Check-in/Check-out: Check-in time is 4:00 PM HST. Check-out time is 11:00 AM HST. Early check-in or late check-out may be available for an additional fee, subject to availability.
4.3 Property Care: Guests are responsible for:
- Keeping the property and all furnishings in good order
- Reporting any damages or maintenance issues promptly
- Adhering to the no-smoking policy in all areas of the property
- Complying with the building's noise restrictions
4.4 Damage Deposit: A damage deposit may be required at the time of booking, which will be refunded within 14 days of check-out, provided no damage is found.
5. Hawaii Transient Accommodations Tax
All rentals are subject to Hawaii State Transient Accommodations Tax (TAT) and General Excise Tax (GET). Our Hawaii Tax ID is: TA-203-1128576-01.

7. Liability and Insurance
The Whaler 1252 is not responsible for any accidents, injuries, or illnesses that occur while on the premises. The homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises.
8. Force Majeure
The Whaler 1252 shall not be liable for events beyond our control which may interfere with your stay, including but not limited to acts of government, acts of God, disasters, disease, war, terrorist activities, civil unrest, or other emergency conditions beyond our reasonable control.
9. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. If we make changes, we will post the updated terms on this page and update the "Last Updated" date.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions.
